Yes, that would work under normal circumstances. I had a lawyer try to negotiate with him before to no avail. The guy is off-the-chart stubborn.

There is an organization called "Lawyers for the Arts." They represent writers pro bono. I'm waiting to hear from one I emailed over the weekend.

Meanwhile, I don't want to give the publisher any advance warning of a possible subpoena (sp?).

I did finally decide to call the publisher's phone numbers. Neither one is working anymore.

What's the technical term for my situation...I believe it's S.O.L.

But this has prodded me to put the book up for sale through cafepress. Thanks to all of you who persisted in nudging me along.

It's fantastic to come in at the end of this thread and see how much "opportunity" can come out of unexpected places -- great to witness!

Personally, I had a logo that I created supporting Melbourne's Commonwealth Games bid (about 12 years ago, well before we ended up getting the nod) used without permission for promoting a meeting in Melbourne of Commonwealth Games representatives from participating countries. I just happened to be at the convention centre for a different event, and noticed my logo in use.

I can't say I was upset: I was pretty happy to see my logo on the screen (and would have given permission anyway) ... but I can see now where I might use that from a "so good it was stolen" story-telling point of view!

Here is a wonderful update to this whole episode. According to cafepress, my book is ranked #10 out of 12,700 books! I don't know how steep the climb would be to take the #1 spot, but if the last week's sales are any indication of the trajectory, it looks like it could keep climbing.

I've spent under $10 advertising during this rise in the charts.

One customer put an image of the book with a link on his website just yesterday. He specifically did not sign up as an affiliate because he prefers to inform visitors that he's not connected financially.

Steve, if you hadn't told me about cafepress, none of this would have happened!
