If they're smart, they will make an option that advertisers can turn on or off. Otherwise, they could get hit with a class-action suit.
Last time I checked, spending a client's money that's earmarked for one marketing campaign on something that they didn't approve is FRAUD.
But again, I'm not a lawyer nor do I offer advice like one. I'm merely sharing my opinion.
