Default Uk Laws and US Businesses - 01-08-2007, 06:16 AM

I am busy struggling on how I am going to comply with the new UK legislation squeezed in before Christmas, and effective almost immediately.

At the same time, I am feeling at least slightly annoyed that a lot of weight is placed on UK businesses having to comply with US regulations especially the FTC if we want to do business with US customers, yet no emphasis is currently placed on the reverse, other than maybe accessibility.

Under the UK and Euro rules, it is thought a contact form isn't enough, you have to supply a real email address, provide full contact details and company registration numbers on all websites and emails. I have even seen it mentioned that a P.O Box is not sufficient for a real physical address.

Will the FTC come into line, or will US companies have to comply regardless if they are accepting business from the EU or UK?

Not sure Andy, but isn't the CAN-Spam Act in the U.S. (remember, I'm Canadian) the same? That is, real email, real address, no P.O. Box, etc?

I think CAN-SPAM allows for PO BOX for email - I don't think it requires company registration details.

This requirement however also covers websites, so even MFA sites could be affected.

Contact forms and customer support systems have been becoming increasingly popular, but from what I have read such a system is not sufficient to comply with the new UK regulations.

I did post it here hoping one of the more legally astute members such as Mike could add some commentary

Adding contact details on sales letters often improves conversions anyway, but affiliate marketers tend to avoid such measures on their squeeze pages for many obvious reasons.

Maybe because some lawyers posting online are more familiar with US laws.

It just so happens many of the lawyers I've learned a lot online from are both
US-based and (thus) more knowledgeable with US laws. I've yet to meet one
who's based in the UK, Australia, or anywhere else who's intimately familiar
with their countries' respective laws and internet marketing in "general".

If you know one, kindly invite him here or whereever so we'll have extra eyes
and ears. Never hurts to have more.
